Re filing of dismissed dv

Good day My wifes dv case was dismissed due to non apperance and failure of presenting evidences. But now i came to know that they are trying to revoke the case again. Is that possible. Please advice

Yes, Reopening of DV Act case is possible

Yes.

Even if case was dismissed, they can file new case with new grounds.

No need of opening old case.  Though they can open old case also.

By the way what did you do? Domestic violence?

D.V case dismissed in default,can be restored.

And that re-opened/new case can also be handled, on merits.

thanks.....Actually there was a interim maintenece order. Is it sensible to move an application to cancel that order by virtue of change of circumstances, before they reopen the case.. Or wait.... please advice

You cannot do anything now. If case is dismissed interim order has no effect. If they reopen the case, then you can file the application
