Refund of Rental Deposit

Good day, I had rented out a property in Pune which has now been vacated. As per the terms in the agreement, it is mentioned that tenant will get the property painted prior handing over the property to me. However this was not done. Is it legal to deduct this amount from his deposit.

If this thing has been mentioned in the rent agreement that you can deduct the amount for this purpose ,
you can deduct otherwise not.
