Service tax on property rent

i have rented out a shop premises @ Rs 1,10,000 per month 

as per agreement the service tax on the rent amount is payable by tenant 

i have already obtained service tax a/c no from the income tax department ..

but tenant is not paying the service tax to me , and the service tax is unpaid

 

in this case who will be responsible in the eyes of income tax department if the service tax is not paid..

It is your obligation to pay the tax. You can recover it from the tenant as per your agreement.

you will be held responsible if tax is not paid.

 

1st pay the tax n then recover the amt from tenant as per the agreement.
