Uncle rufsed for regisrty of the land

 

In 1992, my father paid his brother Rs 20000 for buying land from him. He promised to get the land registered. Any kind of agreement or biana was not made at that time as my father trusted his brother. My father started constructing the house on the land. Meanwhile uncle kept making the false promise of registering the land. As we were living in other city so it took nearly 10 years to complete the house. In 2003 we shifted to our new house and my uncle completely refused for the registry of the land. We are living in this house since 2003. We do not have any kind of papers of the land.  

How can we get the land registered?

how can we sell the house?

Sir,

You must have some tangible evidence which will stand inspection to go to the Court for the land, like: 

  • If your father paid the money with a cheque, or
  • if there is a trustworthy witness to the agreement,
  • if you have any written evidence from your uncle promising to transfer the land to your father's name, or
  • any piece of evidence that will stand up in a Court of Law

Then and only then you can succeed, however a lawyer's counsel will be better.

Now , you have to compromise with your uncle because , without transfer land  from him to your father, you have constructed house on that plot, the said plot is still in his name, so he may have a ill intention to grab this house.

Once again , you request him to  complete registry  of the said land as you have to pay remaining balance of money for that plot.  If  he is not willing, you get back your money , which was spent for construction.  There is a crucial need for settlement in this case.
