the facts may not match but the ratio or the principle laid down by the SC in statutory notice cases, has an effective implication to win your case, im sure.

In T.P. act notice under Sec 106 does not fall withen preview of "statutory notice cases". For Sec 80 CPC there are many case laws but being specific when sending of notice depends on contract between the parties (in this case tenancy contract) than what will be condition.
