In the LA App Number 1195/2008, the Delhi High Court increased the compensation of land owners for their acquired land. Another land owner of the same village was left out as his lawyer did not file the appeal in time even though they had deposited the court fee. Further, when they filed the appeal after much delay, it was rejected on grounds of delay. Further, SLP was also rejected and subsequently, Review Petition was also rejected but none of the courts condoned the delay in filing the appeal due to mistake of the lawyer.
My question is, can the Judgment in LA App Number 1195/2008 by the Delhi High Court be applied to the aggrieved farmer without going into the complications of the delay in filing the appeal and all?
