My (deceased) father was presented “Kulmukhtyarpatra” (power of attorney, POA) for signing by his brother, but he hadn't signed. Does this extinguishes my father's right on getting possession of property of my father's father?
In fact, on basis of this POA (not signed by my father) was pleased to put his name from appellant to defendants, and not given right in the final decree as to get possession of my grandfathers property. This dispute went on y filing writ petitions before high court asking for fundamental right as male coparcerner and high court gave decision that all other who signed on POA has to get possession of property, but not to deal, dispose the property. An appeal in supreme court also held up this decision denying my father's right.
Based on above decision, other LHs have taken possession started shop enjoying income from that property and depriving of my father's rights.
What can be solution? Can we file criminal suit against others?
