Many unspeakable injustices. A case was filed few years ago as 'Civil matter'. More injustices in Court too. Got 'Proof of illegalities" & need be filed as Writ in higher court. During the period, some crimes happened. Two crimes are registered with police (Knife attack, Theft from locked room). These have brought 'Criminal Components With Police Documents' into the case. The later has FIR Number etc.

 

For best of Justice, should this Writ be filed as 'Civil Writ' or 'Criminal Writ'?

Sir,

Repeated injustices. Civil case filed at last. Opponents cheated in Court. Proof of illegalities got. Case was being readied to file it in higher court (Writ challenges Lower Court Order).

 

Two things happened (1) Knife stab. + Operation.    (2). Then, valuables etc got robbed from locked room.    Police have registered both of these.          The latter (Theft) has FIR too.      

 

These are criminal components in the case & are being placed for the 1ST time before a Court. (This dimension did not exist in the Case at the lower Court). 

 

There are 2 options: (A) File Civil Writ            (B). File Criminal Writ

 

WHICH OPTION WILL BEGET BETTER JUSTICE?     PUT IN OTHER WORDS       CAN THIS BE FILED AS A CRIMINAL CASE?

What are the requirements, procedure to file a Criminal case?
