(Querist) 20 March 2008 This query is : Resolved
What are the informations required by the hospital or dr who performs abortion for a single woman? Are these data private? Who has legal rights to take this data from the hospital? What if the abortion was conducted with the consent of the man invloved. Does he have any rights to legally take the information from the hospital as proof of abortion?

In general, the communication between a patient and his doctor is confidential and should not be disclosed by the doctor or nursing home to any person. However, Indian Evidence Act does not give any privilege to such communication as has been given in case of client and attorney.
In case of a single women, normally such information should not be disclosed to the man, and certainly the man has no right to seek or acquire such information. Further, consent of man is not required to undergo abortion in case of single woman.
