ADMISSIBILITY OF WEBSITE CONTENT AS EVIDENCE.

MY BROTHER HAS BUILT A GUEST HOUSE ON A PROPERTY THAT HAS BEEN WILLED TO ME.

TAKING ADVANTAGE OF MY ABSENSE HE IS RUNNING A GUEST HOUSE WHICH IS WIDELY ADVERTISED ON THE NET.

I HAVE FILED A SUIT FOR POSSESSION WITH THE DELHI HIGH COURT.

I HAVE PLACED COPIES OF ADVERTISEMENTS AT VARIOUS WEBSITES GIVING DISCRIPTION OF THE GUEST HOUSE AND GIVING THE ADDRESS WHICH IS THE ONE WHICH IS THE PROPERTY ADDRESS WHERE I OWN THE FLOOR.

MY QUERY IS

WHAT ARE THE WAYS TO PROVE THE CONTENTS OF THE WEBSITE./

IS THERE A BODY THAT AUTHENTICATES THIS CONTENT LIKE SOME BODIES THAT GO INTO CONTROVERSIAL CD TAPES?

IN SHORT WHAT VIEW DOES HIGH CCOURT TAKE ON THE ADMISSIBILITY OF SUCH NET EVIDENCES.

THE WEBISTES ARE OPERATING TODAY AND ARE VERY MUCH ACTIVE.

instead of going for the web site advertisement you can lead the evidence of third person who is well acquainted with your brother's business running in the house

contents of the website may not prove existence of the guest house. If booking is permissible from the net, do it and obtain proof of such booking. You can also visit the actual place and have photographs of the guest house.

It is for your brother to disprove the contention before the court.The contents of the website could be an authenticated one for your case.

it is plain to me that photographs taken would be evidence.

but in view of the hostile relations that possibility does not arise.

please if you can, answer the query that

if evidence is available at a website and a screenshot is placed before the court , will it consider as evidence.

net booking at website is not allowed.

The website contents are admissible as evidence. Take printout of every such web page containing advertisement. The printout itself at the bottom of the page indicates the webpage address and the date of print. With that you can prove on what date what type of ad was circulating on the website.

Another but very important proof you can get from the "whois" site that can give details of booking of deomain name, date of booking, date up to which valid, name of the adminsitrator and the address of the location. You can take a printout of that webpage also as an evidence.

I HAVE ALREADY TAKEN PRINT OUTS AND ALSO ALL DETAILS FROM THE WHOIS WEBSITE AND PRODUCED THEM AS EVIDENCES.
