Examination report

Dear Experts..

I Got Examination report as per following..

The objection is raised under S 9(1) (b) of the Trade Marks Act 1999, as the mark consists exclusively of words or indications which may serve in trade to designate the kind, purpose of the goods or rendering of the service or other characteristics of the goods or service of one person from those of others, Hence, the above application is liable to be refused.

I am not able to understand quarry properly, Plz tell me how to response this examination report??

Trade mark application status objected

I would like to know how to proceed further for registration of the trade mark which has been objected by the registrar of trade mark and what remedies do we have once it has been objected.


EXAMINATION REPORT OF OUR TRADE MARK APPLICATION IS AS UNDER :::::::::::::---


The above mentioned application has been examined under the provisions of Trade Mark Act,1999 and Trade Mark Rules,2002 and the trade mark applied for is open to objection under the following sections :

1. The trade marks-which are devoid of any distinctive character, that is to say, not capable of distinguishing the goods or services of one person from those of another person;which consist exclusively of marks or indications which may serve in trade to designate the kind, quality, quantity, intended purpose, values, geographical origin or the time of production of the goods or rendering of the service or other characteristics of the goods or service

2. The Trade Mark application is open to objection on relative grounds of refusal under Section 11 of the Act because the same/similar trade mark(s) is/are already on record of the register for the same or similar goods/services.The detail of same/similar trade marks is enclosed herewith

Save as provided in Sec. 12, a trade mark shall not be registered if, because of-its identity with an earlier trade mark and similarity of goods or services covered by; the trade mark; orits similarity to an earlier trade mark and the identity or similarity of the goods or services covered by the trade mark,

Hence, the above application is liable to be refused. Accordingly, you are

requested to submit your response/submissions, if any, along-with supporting documents, with in One Month from the date of receipt of this Examination Report or you may apply for a hearing.

Please Note that if no reply is received or a request for a hearing is applied for within the above mentioned stipulated time ,the said application shall be treated to have been abandoned for lack of prosecution under Section 132 of the Trade Marks Act,1999 and there after the status of application in the computer database shall reflect the factual position

I GET FOLLOWING REPLY FROM REGISTRAR OF TRADEMARK.

Gentlemen/Madam,
The above-said application shell be advertised in the Trade Mark Journal As Accepted under the provisions of section 20(1)of the Trade Marks Act,1999

Please note that if no compliance , if any , is received within the 30 days from thereceipt of this order , the application shall deemed to have been abandoned without any further notice in lack of prosecution under Section 132 of the Act.

Now What Compliance i required to do??

Regarding refund of booking amount

Distribution of property

Muslim Parent wants to distribute properties not among sons but their wives where as the elder son is staying separately with his second wife with out leaving first wife. My query is - - Can the elder son put objection to the property distribution? Or how can the property be transferred to both daughter in laws?

bank loan

I have joint land holdings in agricultural land with my uncle in Punjab. My uncle has taken loan of rs 20lakhs from uco bank which is written in 2009-10 jamabandi, but later died and patwari of village transferred land share to his sons and wife . I think he doesn't informed bank, because in new jamabandi 2014-15, shows my uncle name that he has loan of 20lakhs, but his son and wife holds his land share. Please tell this is legal or illegal. What action we can take and it comes under what rules. Will it affects other joint land holders. Patwari and tehsildars are corrupt.

Property transfer

For my grandfather 6 sons and 3 daughters. And 8 years back he passed away. Now all are ready to devide and make khata to there's name. But one person is abjucting. So now devide and left equal property for him and without his signature can others make khata to there's name.
