Illegal encroachment, illegal toilet & subsidy

have got agriculture land in Nasik District. In the said land the person has encroached the big area. Also he has illegally constructed the toilet & grabbed the toilet subsidy from Grampanchyat/Govt. . I have got all the solid proofs. I am owner of the said agriculture land. Already met PSI but he said that he needs order from Tahisildar from taluka place so that police can give protection to us for removing the encroachment area etc. in agriculture land. Also as he has illegally encroached, illegally constructed the toilet and illegally grabbed the Government Subsidy, for which, he should be arrested due to corruption/cheating the Government. Kindly suggest the legal remedy and as to how to get back the encroachment land area I e short cut way to get it back immediately.

Sunni hanafi law of inheritance

Dear All,



In our case, We are inheriting our great grand mother property, totally she had 3 children, one son who predeceased her and 2 daughters, Hence she was survived by only 2 daughters who are also dead long back and predeceased sons son and daughter.



As per sunni hanafi law daughters are entitled for 2/3rd share jointly as sharers only, remaining 1/3rd share will be divided among predeceased Sons son and sons daughter in ration of 2:1 as residuaries, 2/9 for sons son and 1/9 for sons daughter. Since it is male dominated grandson cannot be excluded by daughters

Since it is a old suit still pending,we have not got possession and muslims rights are calculated after each death.

Among 2 daughters children who are entitled for 2/3rd share jointly one daughters son has only 2 daughters and no son, he has expired recently, another daughter has a male child hence no issue, but other daughters sons has only 2 daughters ..



Question: How the shares are calculated again after the death of Daughters Son since he is survived only by 2 daughters, will they inherit complete 1/3rd share of their father which he inherited from his mother ?



Heirs alive now, 1st daughter Son, 2nd daughters sons(who died recently) 2 daughters and predeceased sons son and daughter.

Harassment by husband

Hello All...
Iam in big trouble and need your help.

I got married on may 2017. It was a love marriage without parents consent in arya samaj mandir. He is an Army officer. To marry him i left my well paid job, my family and city and started living in his city after marriage in a PG. He asked me he wants 2-3 months to get a home in his Army Cantt and to convince his parents. In August he went on leave at his home and met a girl of his parents choice . Soon after der he started asking me to cancell this marriage and started harassing me mentally. I put this matter at front of Army authorities, they asked him to get an accomodation in cantt and updated my name as his wife in office records. From there he started making my life misrable. Ne never talked to me or kept any relation with me. He never stayed at that house and started quarrling with me on daily bases. He just don�t want me and asking me for divorce. Neither my family is supporting me not my husband is accpting me. What to do

125 crpc

HI experts ,

My wife file 125 crpc on me and till 1 years she did not turn for the dates , so we give the application to the judge of family court-1 to DD this case and the same was accepted and the case disposed after one month she again file 125crpc in the family court -2 and we got notice from the court ,,,
when we asked the lawyer he said yes she can do it ,,,,,

how is it possible ? As per my knowledge person can't file same case for the same person for the same reason which is mention in constitution of india ....and if it is possible then there is no end of this cases ...


Please experts guide me what i can do in this .

Perjury in dv 2005

HI Experts ,

I have query to ask about the dv , My wife files dv-2005 on me and my family member on dated 14/5/2017 and she left the metromonial house at 27/11/2014 so the case filing gap is 2 years and 10 months , Secondly we both dont have baby during the marriage life though she mention in the dv like ...

1. " Protection of me and my childrens "
2. " We required 30k for herself and for children and their education "

Now i dont understand from where this children came ???
From the surfing i came to know that i have two way to fight this

1. on the groun of sepration period that dv not applicable if its applied after one year
2. perjury ipc 191,193

i have concern with lawyers in my own circle but you will suprise that they not have any idea about it ...

Please guide me what i supposed to do ... can any one give me format of perjury

Marriage Related issues

Hi, please give me your valuable advice

I got married 2 years back, I have no child. Since starting my wife dominated me. She doesn't respect me and my family members. She uses abusive laungage. Many times she has beaten me. She threatens of police complaint. I have been totally mentally disturbed. Now me and my family doesn't want to keep her. She is trying to trap us in false 498a case. Also putting false allegations which have no base. No one in her family is read to talk. How can I get rid of her. Should I apply for divorce, how long it will run in court. So far no FIR has been registered from either side.

Spelling mistake in birth certificate

Hai sir, am durgalakshmi from tamilnadu. I born on 1990. My mother name meenakshi. All other certificate and ration card name also durgalakshmi.. but i brought my birth certificate in 2004. In that certificate my name is durga devi and my mother name is meena. How can i change these names sir .. plz tell me...

Dv/crpc 125/rcr

My wife registered DV against me and my parents which is in "Issue of notice" stage .Mean while she filed Crpc 125,for which I submitted a objection statement with her qualification and work experiences. While submitting objection for Crpc125, judge informed us that she also filed section 9 of RCR which is also in "Issue of notice”. For Crpc 125 case referred us to counseling. Counseling was successful, she agreed in front of counselor to re-union back to matrimonial home without any condition. Counselor submitted report to court stating“Counseling between the parties was successful and disputes were settled”. On counseling day her advocate told they will withdraw the DV and through joint memo these cases can be settled. She suppose to be appear to court last week, but she was absent & now through her advocate putting new condition that DV case she won’t withdraw till my parents leave separately. She wants to put both Crpc 125& RCR case on observation. I need advice from experts on my further action. For her RCR,till now i not submitted any replay,(i,e objection or no-objection), for her Crpc 125 objection is submitted .I am not at all ready to accept her condition of keeping my parents separate. She is not allowing me to see my 4 year daughter & recently stating her health condition she also left the job.

Only child (daughter's) share in property_muslim law

I am Muslim married women. An only child of my parents. My both parents were earning but all the properties are in the name of my father only. My mother died and my father got re-married but with no children further. He has already transferred all the monetary values (money) from my mother's account into his account. Now that, the property is also in his name and he has got re-married. What shall be my share in his property? and How the same can be divided?

RCR defending case

Hi wrt to.following fact I want to put before family court for RCR defense
1) my wife left our home along with her father saying she will return in 15 days and that time she was working as clerk in SBI branch near my home just 3 km in city.
2) from her parental place she applied for transfer at her request to.parental.place without taking permission of husband.
3) she informed only when we asked her why you are not.coming.
4) SBI has transfer policy ie married women should be transferred near to husband place as possible or vice versa and unmarried girl near to her parental.place.
5) she had joined SBI branch at my place on spouse policy just 6 month back.
6)even branch manger is transferred after 3 yr on routine category or in case of emergency while sub juniors like assistant clerk can apply for.transfer after 5 yr of service in particular branch
7) my wife gave DV by inlaws as a reason for transfer which is wrong as she left with her father.
So can these point be useful to fight RCR case as my wife clearly saying she cant live with husband and MIL at our permanemt residance and forcing me to leave my place and mother
