6 months notice period - Legal or not legal in india

I am working in an organization whose manpower capacity is less than 100. As major projects are on-site they have this clause mentioned in their HR policy that if the employee is on-site he needs to serve notice period of 6 months. However in offer letter it states 90 days notice period and also a statement stating go through the HR policy. Can we challenge the offer letter and contradicted HR policy clause for notice period in labour court.

Does ESIC absolve liability of WC

Hi Experts,

My plant is not falling under ESIC and WC is applicable to us.

Since we are green field, they are so many labour contractors, now I am facing issue in applicability of ESIC as many contractor have their offices in ESIC area and they are regularly paying contribution to employees working for them.

My question is that if my premises is not falling under ESIC can I ask contractors to bring wc or esic absolve the mobility of wc.

Compulsory retirement - reg

Respected Experts,
I have been compulsorily retired from service subsequent to a departmental enquiry. The order of order of compulsory retirement has not specified any reduction/cut in my pension or gratuity. Now my query is whether i am entitled for 3 months pay as no notice has been served for the compulsory retirement. I am governed under CCS PENSION RULES 1971.

Hi! I am working in a private school since July 2004. I have completed 15 years of service. I have resigned from my job. I am eligible for gratuity. What amount shall i expect from the management. Kindly guide me.

Leave during notice period

An employee resigned from service due to medical problems
He applied for Half Pay Leave for two months during notice period
Leave was regularised by the employer

Now while settling dues employer is deducting full notice period of 3 months from earned leave account

Whether adjustment should be for one month or three months

concealment of facts

I had hidden higher qualification from my psu employer and i want to apply for other gov job for the qualification which i hidded from my employer. I want to know if i can apply for new gov job or not because my employer do not provide Noc to apply for the new gov job of higher qualfication

Harassment from bank

Sir, I would like to request you to suggest me the steps to be taken in the case of Bank being irresponsible in filing a counter to the case filed against the Bank with regards to illegal termination. The case is filed one year back. But, till now, the Bank did not file the counter.

Sir, I Have a psu job in which maximum qualification is 12th and i am a graduate now i have selected in other gov job which is of graduation level and i did not mention about the current job in the attesation form please tell me if police verification is done my previous employement can be traced or not

Unfair Bond Terms

I was appointed as Trainee Jr.Officer in a Co op Bank. The appointment letter mentions a Bond period of 1 yr and 1 month notice period. Also a deposit of Rs. 10000/- in my name was kept as deposit for a period of 1 yr renewable from time to time. 6 months later I got a confirmation letter where the terms of appointment remains unchanged was mentioned in the letter.
However after completion of my 1 yr from joining, my FD is still not being released by the Bank, whereas they have released FD of a Clerk whose appointment letter had same clause as mine with respect to FD. Also now I am being asked to submit a bond for a period of 2 years with 2 months notice period or 2 months salary in lieu of notice period, which is against the terms and clauses of my original appointment letter. On questioning about the same, I was informed verbally that it is the managements decision and the terms of appointment letter can change from time to timw
How can I protect myself in this case.Is there any rule which allows such changes in the original appointment letter???

Transfer of a govt emloyee

if the transfer of a goverment employee done only for accommodate a person who is choice of local MLA his transfer done on the recommendation of local MLA and without any administrative exigency or public interest the employer has issue the transfer order as recommended by MLA without any opinion on recommendation or administrative exigency or public interest about the transfer after a week, that employee again transferred from his new posting to another new posting, because the same MLA wants accommodate another person of his choice also on that new posting. and employer has issue the new transfer order as recommended by MLA without any opinion or objaction fact is crystel clear on the notesheet of office of employer and by recommendation letter of MLA, but in the light of apex court citation given in SL ABBAS case, the single bench of highcourt denied to interfare in matter, appeal has been in division bench but no hope also in there what is the further remady any citation of apex court about this type of matter ( state -- Madhya Pradesh Where is no Tribunal)
