Gratuity - central government - resignation

I have resigned after serving 6 years of uninterrupted service in Central Government. Am I eligible for gratuity?

Payment of Gratuity Act, 1972 , para 4 states that 5 years of service is required for payment of gratuity.

26(I) of CCS(pension) rule , 1972 states that my past service stands forfeited after resignation .

However, para 2, CCS(pension) rule 1972 states that it applies to Government servants appointed on or before 31st day of December,2003. As I was appointed in 2015, Is CCS (pension) rule applicable for me ??

If no, its rule 26(I) for forfeiture also does not apply to me? Does that imply I may be eligible for gratuity payment?

Delay in filing the reply statement - reg.

I am governed by CCS (Pension) Rules, 1971. My disbursement of pension was delayed for 3 years by my office due to their administrative lapses. I have filed for interest and compensation before the Central Administrative Tribunal, Chennai. The case was numbered and posted before the Registrar for completion of pleadings. On the scheduled date, the Registrar has informed that the Respondent has not filed the reply statement and therefore it was pending to place before the Member for further process. Nearly two years to be completed. But the Respondent has not filed the reply statement. My case was not listed for the last six months. How can I request the Tribunal to proceed further and declare Ex-parte for Respondent side. I am appearing as Party In-person Please guide me. Thanks in advance.

Promotion related issue

Sir/Madam,
I have been denied promotion though I was 4th in the Seniority list out of 9 and having 1st or 2nd in terms of pre-interview marks. Interview marks consists of 10 marks only. I was having 3 to 4.5 marks more than other candidates. Three candidates who joined one year later to me promoted ahead of me. They become equivalent to me because of the changes in promotion policy from 4 to 3 years over a period of time. Once they got promotion in 2.5 years as well with retrospective effect (Promoted in December but with effect from June in 2.5 years). Candidates who got promotion were 1, 6,7 & 9 in the list out of nine. I already a wrote letter to the management seeking reason for non-promotion. I am working in a PSU (Central Govt undertaking). Kindly guide me on this matter.

Illegally suspended, not give orignal copy also

My company has suspended from duty on immediate effect. They have sent me Xerox copy of charge sheet by speed post. I have requested them to send original copy of the said charge sheet, they are deliberately not sending original copy of the charge sheet, I have sent 3 reminders by speed post but they ignore to reply. All my access to the company have been forceably blocked. Since I was working from home I have their computer along with me, hr sent a mail to return the computer, she has said that I am suspended. Should I return the computer. I have asked for the status of my employment to the head HR but they are not replying to any emails. I am not sure also that I will get salary for this month September 2021 also. They have illegally suspended nor they have given me any orignal copy of the same.
What can be done. Pls help me. I am a poor person and I am the only earning member in my family, children are studying and wife is house wife. Pls suggest me.

Is ex-gratia amount (for completed & remaining service) given by employer if an employee himself opts for VRS after completing 20 years of service ??

Releving latter not received as terminated

Dear Team,
I was working with Pvt Bank As Branch Operation Offices . I made up financial mistake that i keep excess cash with me and when it comes shortage I had paid it. due to this i had not get my Releving Later and terminated I have requested bankfor latter but the reply we can not issue the same although while this incidence happen i am already on notice period.
request you to kindly help me about this.as due to this i am not getting Banking job since 3 years.

Any limitations to file complain with labour commissioner

Hi,
I was been suspended without getting a show cause notice, the company all of a sudden stopped all my access on 18 August 2021 and sent me a Xerox copy of charge sheet and show cause notice, post dated, on my personal email id. After two days I got xeror copy not original copy of the charge sheet and show cause notice, I sent several letters by speed post to the Head HR to send me a Original copy on the company letter head, if they want my reply to the charge sheet, but they did not send so. Do they need to serve show cause notice before filling the charge sheet as per rule. Secondly as per rule can company send Xerox copy of charge sheet to employee and force them to reply. Thirdly is there any limitations to file a complain with the Labour commissioner and Labour court after being suspended. You can email me francis.santamaria76@gmail.com. Pls suggest me.

Bond and marksheet

Hello Sir,
I just wanted to inform you that I have produced my original documents and signed a contract for 12 +2 (months of training) and now even after completing the bond they are not giving the marksheet and they are harrassing me to continue working for the leaves which I took in between during the covid lockdown and a 15 days of bus strike in Bengaluru. Can u please help me out sir. Im stuck and I'm very depressed and I'm not able to apply for my dream job anymore.
