BONUS

Sir, I have a staff working in my Company in Kolkata , Please let me know the bonus which I have to pay? Is The Salary I paid him in the financial year 2018-19. Or as per the current salary of financial year 2019-20 which has now been increased.

Full and final settlement

I was working with a MNC having registered office in New Delhi and Corporate Head Office with Factory in Greater Noida. I was working as a Manager in Mumbai Branch office since 01.08.2017 to 29.05.2019. I have resigned from my job w.e.f. 30.04.2019 giving one months notice instead of three months as per company policy. After rigorous followup I have received Full & Final settlement calculation as under: -
Amount Payable = Gross Salary for Month of May + Leave Balance (as per Basic Salary) + Tour Expenses (Zero) + Bonus (Zero for FY 18-19)
Amount Deducted = Short Notice ( 2 months Gross Salary)
Net Receivable is minus One Lac i.e. I need to pay Rs. 1,00,000/- to company.
How I can defend this case and claim my performance bonus of Rs. 1,50,000/-
How I can defend about deduction of gross salary for two months.
Please help me in this regard.

Provisional pension

My relative has been convicted by lower court in anti corruption case. However, before conviction, he got retired with all retirement benefits except pension which was sub judice at that time(for all employees). Post retirement, pension case was won and it was paid to other retired employees except my relative, on grounds of conviction in lower court.
Is he entitled to provisional pension pending appeal in higher courts.

Notice how many times

We have filed consuerm complaint for deficiency in service as fridge was not repaired brought on 20-2-2019.
We have filed it at Coonoor Consumer Cort.
Notice sent for past 9 months, nearly 14 times. Each date only notice.

Party not available. Party not take notice.
like that RPAD come back.

So our qauestion is. How many times will consumer court send notice to respondents? Is there any limit? Cant they decide csae exparte?

Contractual nursing staff duties

Sir,
Can the authorities of government hospital force Contractual Nurses to do 3 or 4 duties a week (12 hrs) i.e alternate day night duties. With no Casual leave.

Is there any legal guidelines regarding night duty hours for nurses in government hospital.

Salary In Hold

I was working for an organisation named Biolozik.corporation I have given them a notice period of 10 days before leaving and they promised me to give the compensation only till I worked even I agreed on that but when my notice period is over they haven�t paid me my August salary also. It is September 20 now and they do not even reply my text nor they call me back.

Probation period and confirmed

Hello Sir,

I was working with organization in which the appointment letter has clause that I will. Be on probation for six month after probation period my employment will be confirmed by written confirmation and my notice period will become of six months post confirmation. Previously it was 1 month.

They send me one email after 7 months stating that you service is confirmed please provide your acceptance. Please feel to ask any query.

And the confirmation letter they send is of any other employee in the attachment.

Do I become confirmed employee now and my notice become 3 months. Or not my np will be considered as one month only.

Maternity leave related

Dear Sir/Ma'am,
I, Neha Somani-Panchal, am an employee of an Private organisation in Nariman Point,Mumbai. I am 7months pregnant now and about to complete 1 year in the same organisation next month i.e. 15th October,2019.

However, my company is asking me to resign from my job giving the reason of no business(profits) and also company policy states that:
A permanent employee who has completed 24 months in the establishment are eligible for 12 weeks Maternity Leave.

Wanted your guidance in the above scenario and what should I do further.
Looking forward for your response at the earliest.

Gratuity payment

Hi Friends,

I am working in NSE & BSE Listed company since 26th Dec 2014. I have resigned from job on 16th Sep 2019 and my last working day will be 15th Nov 2019. I will be completing 4 years 10 months and 19 days till last day of working. Please tell whether I am eligible for Gratuity or not? Also share SC judgement if any as my HR is confirming that they will pay Gratuity only when I will complete 5 years i.e I have to work till 26th Dec 19. Please also tell what remedies I have if employer refuse to pay the Gratuity amount.

Recovery of basic pay with allowances

I worked in PSU & my factory gave 1928/- yearly increment in lieu of 480/- in June 2014 by mistake.I retired in Nov 2015. Now they send me letter for recovery of Rs 92062/- in AUG 2019 after four years of my retirement for extra basic pay & allowances paid to me.
Kindly suggest as per law my factory can reduce my basic after 5 years.
