Punishment without court of inquiry

Respected Sir,
1) My friend is central governmennt employee. He went to avail lunch break in due time, but security staff resisted him since lunch memorandum was not given to security staff by head of department.
2) Upon verbal request my friend went out from office in schedule lunch time & come back in due time.
3) After some days security staff lodge a complaint that my friend had been avail lunch & went home forcefully & it is against security rule.
4) Department issued show cause letter to my friend & my friend has stated that since head of f
department forgotten to sent lunch memorandum in due time, hence my friend went to home in schedule lunch time upon verbal request to security staff.
5) Being dissatisfied of above reply, the department ask my friend for representation of fact.
6) In reply my friend stated the facts.
7)Thereafter without any Court of Inquiry, depatment proceed for punishment againt my friend under rule 16 of CCS Conduct Rule, the department also stated that (in weiting) since accused did not requested for Court of Inquiry (COI), hence COI is not necessary.

Can my frend approach CAT for wrongful proceeding against him?
Stop punishment.

Upsc attestation form- declaration of drunk and drive fine

Sir,
I have been convicted for drunk and drive in 2019. I have recently applied for UPSC civil services. Do in need to declare Yes in the attestation form when asked whether i am fined by a court of law. I have a general order copy downloaded from the court website which does not mention my name.

Pay protection

Sir
I joined IIT Indore as Jr Technical Superintendent (Level 6) however before joining IIT I was working in PSU of DoT , TCIL on IDA E4 (equivalent to level 11) due to some personal issues I applied through proper channel and provided NOC to IIT. I would like to ask whether I will get Pay Protection in IIT. I have already submitted the representation in this regard in IIT.

Regarding catching cheating spouse

Trust me its best to always know what your partner is up to. My ex partner was acting shady by going to corners to pick up calls at odd hours. when i asked who he was on the phone with he told me its work related. Use interview se leke joining tak use uske home location se 40 km k ander joining Dene ko kha gya lekin uske kuch staff apne fayde k liye us ladke ko 80 km dur joining de rhe h .
Ab ladke ko kya karna chaiye

Resignation from bank

Hello sir i have been working with a public sector bank as head cashier from past 6 years and i got selected in state government job.
The state government didn't gave me any extension in joining and required me to join immediately and put immediate resignation in bank via email so i did accordingly and put my resignation and also in my resignation letter i mentioned that "SINCE I AM UNABLE TO SERVE THE BANK FOR 1 MONTH NOTICE PERIOD So In accordance with Service Rules Para 522 Clause 3 of Sastry Award – I UNDERTAKE TO PAY THE BANK FULL ONE MONTH’S GROSS PAY AND ALLOWANCES AS MAY BE CALCULATED BY THE BANK IN LIEU OF SERVING NOTICE PERIOD and AUTHORISE THE BANK TO DEBIT THE SAME FROM MY SAVING ACCOUNT" and then on the same day of submitting my resignation i joined state government job but now my branch manager is asking me to join for some days, i have not disclosed to bank that i have been selected in state government and joined the same, i have said that i am giving resignation on personal grounds. Can bank take any action against me ?

Dual pf issue(pf overlapping issue)

Dear LawyersClub team,

I have a pf overlapping issue for 5 months 10 days. This is in the year 2021. I have joined company A in 22Feb21 and they said it is development job but when I joined it was not a development job it was support job, so meanwhile I was giving interview to other company as well Company B offer me to join and I joined company B in 10Mar21 also to check whether this company is going to give me development work or not. But company B hadn't provided laptop for 40 days and I was continuing with company A. After 40 days company B sent laptop and found out that company B is giving development work so I resigned from company A and given notice of 2 months due to all this pf overlapped with 5 months and 10days. I left company B also after 1 month. Also I had talked with both the company to resolve it but both the company are not ready to resolve it. Now I am unable to attend any interview due to background check fail. Please suggest how can I resolve it. Please reply.

Excess salary credited

I was working for a company where in I had a bond what if I leave within 3years I have to pay 1.5lakhs. However I left after 2years and paid 1.5 lakhs, but I was not given a salary increment and they had changed the increment cycle to July without prior notice. I left in August, so basically from April I have not been given raise, but still I had to pay 1.5lakhs bond. But I had adjusted the August month salary with 1.5lakhs, by paying 1.2 lakhs. Suddenly on August last day I received August month salary. But now after 15 days they are asking me to pay back the amount. So legat what should I do considering bond , no increment in salary and all. Thanks

Unpaid salary

A poor village man who worked in a co.operative agri credit society. He retired 10 years back. he was not given gratuity and unpaid salary for for 10 months. He moved a writ in high court 4 years back for gratuity and got an order to pay on merits and according to law. The deputy registrar got him into agreemnent with the society that Rs. 10,000 per month would be paid. But they did not do. randomly paid almost half of the amount. now a reply recived for a letter that they would pay periodically gratuities. not talking about unpaid salary. how to get this unpaid salary? legal avenues? please advise
