Advocate representing plaintiff , whether he can represent defendant who admits plaintiffs claim? Under which provision and citation if any.??
Respected experts, I want to know the extent of compensation that can be covered under consumer law. My client had booked bus tickets upto one place and then had arranged a Metador van to reach another place. There he had made arrangements for his stay paying advance payments for reservations. If there is serious deficiency in the bus service and thus he could not avail all the further services, can he claim compensation for the further payments he had made for his trip? Please provide case laws, if available and help.
All Experts,
U/S 260 CrPC can IPC 500,509 private complaints with 2-3 witnesses be pushed for to be treated as summary triable cases or judicial discreation that it cannot be treted as summary triable can exist?
What particular or what conditions needed to be that the cases be treated as summary triable or like a normal criminal procedure?
If summary triable is not insisted by the judge and trial proceeds under the normal way then can still the accused take protection under the exception of ipc 499?
Regards,
i wanted to know that what is the qualification and which are the exams we need to pass for entering in judicial service? and also what is judicial service?
I AM A STUDENT OF LAW, I CAME ACROSS THIS PROBLEM SO NEED HELP
The Problem:-
The companies A and B are in business with each other. During the course of their business a Company C takes over the company A. Now, the dissolved company A had been in some business transaction with B and the payment was due at the time of dissolution.
The new company C now has to pay it.
MY QUESTION IS THAT COMPANY C HAS TO MAKE AN INDEMNITY BOND ABOUT THE DUE PAYMENT.
WHAT SHOULD BE THE CLAUSES THAT SHOULD BE MENTIONED IN THE DRAFT???
Is it necessary to apply application for proclamation of offenders in cout. or the court will do it without the request of the plaintiff?

Legal position..... whether person is dead or live....
1-THE PERSON IS NOT TRACEABLE FROM LAST SEVEN YEARS.
2-NO BODOY HAVE SEEN / HEARD ANYTHING ABOUT THE PERSON
3-FIR
4-NOTICE IN ATLEAST TWO LEADING NEWS PAPERS
Section 108 of the Evidence Act.
- Burden of proving that person is alive who has not been heard of for seven years. -
Provided that when the question is whether a man is alive or dead, and it is proved that he has not been heard of for seven years by those who would naturally have heard of him if he had been alive, the burden of proving that he is alive is shifted to the person who affirms it.
Note- Man declared dead after seven years as per evidence Act.
Now my query is What happened after 8 years – no news, not heard and he one fine morning traced and found alive.
Is he dead or alive.
If he is alive then what will be the status during not seen or heard and thus declared dead by Court.
