Contempt case

sir

I was not considered for promotion in the year 1998. The Delhi high court gave judgement in my favour. Vide court order the department directed me to appear before the review Assessment Board, for the year 1998. The board declared me 'not yet fit' for promotion.

I needed 60% marks in the Board for being declared fit for promotion.

Supreme court in various judgemnt has given the following ruling.

1. The interview marks cannot be more than 10-15% of the total marks of written examination/Marks of ACR.
2. Result should be declared after considering the total marks of
1 written examination/ACR marks
2.interview

In my case i had obtained 778/800 marks in ACR.
marks for ACR = 800
marks for interview = 100
Total = 900
60% of 900 = 540
Since I have obtained more than 540 marks (782 marks ) in ACR itself the deparment should have declared me fit for promotion. Thus deparment has wrongly complied the judgement. can I file contempt of court.

Lien in government job


sir, pl tell me what is the procedure of holding lien for a permanent central government servant while going from central government to autonomous bodies (on appointment applied through proper channel).?
will the person hold lien of 2 years in parent deparment (central government) or till confirmation in autonomous bodies which ever is earlier? if yes, quote the circular no.?

Will the parent department (central govt)continue to keep the employee who has joined autonomous body ON STRENGTH (on roll) till the completion of LIEN ie 02 years or otherwise i.e struck of strength?


i urgently need help in this regard...

Marriage validaty

I am a hindu and got married to a muslim girl. The marriage was performed in a temple with friends as witness and also it was taken in written from me and my wife that she is a muslim and converting her name and religion to hindu. Also later we had signed on a notary paper that we are marring each other with full consent and also she had signed another notary paper that she is changing her religion and name to hindu and both papers were also signed by the padit that he has performed conversion and marriage. The same affedivits( of marriage and religion conversion of my wife) was used to register our marriage at a municipality ward. We received our marriage certificate, but it shows my wifes old name and not the new one.

Now i have heard that marriage as per hindu act can be only performed only if both are hindus. And also that to convert your religion and name u have to give advertisement in paper and some legal procedure is there. Which my lawyer suggested that we will perform now for my wife after marriage.

Does it mean that my marriage is invalid and i have to first change my wifes name and religion by giving advertisement in paper and perform all legal procedures and then remarry her or is the previous marriage valid and i have to just perform now remaining legal procedures of changing name and religion of my wife.

Separation case

First of all I thank Mr Shonee Kapoor, Shailesh Kr.Shah,Mr Nadeem Qureshi for giving right advice from time to time.

My son's judicial separation case was in mediation where finally judge has also told the wife to go for mutual divorce.

She is not ready for divorce.They have not filed any case except for maintenance against us. Staying separate for the last 11 months. They want to fight the case in court.

How much maximuma they can prolong. The girl is follower of Osho.

Our next date for hearing is in Feb 2012

Divorce --mandatory period

Due to harassment my sister filed complained under Domestic violence act and also lodged 498A in 2007. Settlement efforts were made on our behalf and even my sister gone to live separately with her husband, but life was not settled as her husband was having relation with other girl.
Now both the parties agreed for divorce with one time payment of lifetime alimony to my sister and for boy having age of 5 years.

Can we avoid 6 months mandatory period in family court for divorce ? or is there any other way to end relationship i.e. mutual divorce before notary and later on to register the same.

They are living saperately since 2007.

Case status query

Mycase status is showing Admitted (unready)
and stage is Final Hearing (High on Board).
For the last one year my this case is not appearing on board. Kindly guide me what I have to do so that the case may be put on board for hearing.

Land partition - kindly advice,

Dear Experts, Kindly Advice..

Mrs. 'X' had 7 childrens namely A,B,C,D,E,F,G. She had 27 cents of land in her name at the time of her Death. In RTC, 3 names are included (X & 2 childers), those are 'X', 'A' & 'B',
'A' & 'B' both have expired and have 3 & 6 childrens each. Now Childrens of 'A' & 'B' want their 33% share each as mentioned in the RTC ( divided in to 3 names) Also 1/7 th share which belongs to 'X' at the time of her death.
But for this settlement other Childrens of Mrs.'X' who are namely C,D,E,F & G,are not accepting. They demand for Full share of 27 cents land to be divided equally among 7 childrens, for which Childrens of A&B not accepting.

Kindly advise how this matter need to be settled & what does the LAW says. Does it require to to shared equally among all the childrens of X, or only the 33% of X, need to be shared between 7 childrens of X.

Title

Dear Sir/Madam,

Basically i am from Bihar and by profession i am Manager Telcom Engineer. My Father was Central government employee and now he has dead. We have ancestral property in Saharsa, Bihar. we are leaving from 1965 After new map configured the pla\ots are rearrange on this position.so the other person near by my plot has rezite the plots are OK but the old map of my plot is ok. So that is the mad person he doesnot talking of right way. so we title of this plot , and running more than 10 yrs.after title is dissmiss. Again we try to challaenging title for decision and other party is construction contineu by forcly.

Please suggest me what should what is action for my side.we are two brothers both are leaving out of station.

Custody of minor male child.

Dear All,

I Have filed Case Against my Wife for Custody of my son as she is leading a Adulterous life and which has been Proved in the Court of Law.She is not bringing the child to Court even after directed by the Honorable Judge and not even filing the Objections.When she was informed to get the child and file objection for last hearing she did not appear and the honorable judge recorded Objections not filed. What actions can be taken to get my son custody. Please guide me.
