In my company one director has not drawing any salary due to losses since January-2012. upto December -2011 he was taking salary Rs. 150000 per month. He is still a director but not taking any salary. Can he withdraw his gratuity amount or not. if not, how provision for gratuity can be made. It will be made as per last drawn salary of Rs. 150000 or salary taken in march-2013 and that is Zero. How his period of service will be decided for Gratuity purpose. If anyone can resolve my query I will be very thankful to him.
In criminal case, property i.e. (F.D.R. in bank)in the name of third party ceased by police from third party which is not linked with case property and deposited with court. How third party can lead evidence defend to prove that the property ceased by police is self acquired and his own property? Can third party intervene to prove the ownership?

if in a case the lawyer of opposite party X commits an offence of contempt.then can y being the lawyer opposite to X pleade to court to first decide the matter of contempt committed by X and then hear the case for which X and Y are pleading in court?

One member has filed complaint under consumer forum against Builder for not alloting 2 parking as assured and only one parking is allowed. Further his maintenance amount as agreed by him was supposed to starts after possession but society is demand more then that.
The member has filed case in consumer forum regarding 2nd car parking which assured by society that they will give it to him but till date they have not handed over and second is amount of maintenance.
The forum has directed complainant to make society party.
I am for society. My query is that can society made party to present consumer complaint. Is it a proper forum. What should be my stand to save my client i.e. society.

Hi, I am working in a private limited company at the time of interview the company say me that i have to sign a bond for 2 years. It is just for the stability for 2 years with our company and no other conditions will be extra apart from this. When I have joined the company then they said we have to give a security amount cheque against the bond i.e. Rs. 2,50,000/-. Now 4 months back they started to torture me, like misbehavior (talking with abusing), late salary and now they are not giving my my salary i don't know why. I am completely exhausted with current job due to the continuous torture by the MD.
could you please advice if i quit what are the possible legal problems and also kindly advice what to do before goinG to quit.

well i was working in a state govt university as an assistant prof.(on full scale-Sanctioned Post of Gujarat Govt.) on probation of 2 years. every year i got appreciation letters from higher authorities of the university for additional and good work. i never received any memo or notice or improvement warning to my work conduct/discipline during probation. But surprisingly & shockingly before one month of the completion of my probation. i received termination letter in my hand. when i asked about reasons to terminate my services through RTI. they mentioned three reasons for my termination are 1) Annual Confidential Reports were spoiled by my Concerned Head of Departments 2) one inquiry regarding my misconduct 3) work Experience certificate was found forge. All above mentioned charges don't you think so punitive and stigmatic in my case and also never communicated all above charges to me ever during service. Even though if termination is smpliciter but atleast they will have give me warning or notice for improvement. Moreover i have filed case regarding promotion in Hon-able High Court of Gujarat before this incident happen. I am 100 % sure this malafied intention. straightway without notice i was terminated Is this possible without follow the procedure of Principle of natural justice Kindly let me know what are the chances to win this case in my favor. Then i filed application regarding my case in Gujarat Educational Tribunal. but finally they didn't consider the facts of my case they dismissed my appeal by saying that it's simpliciter termination. Now recently i appealed in Honorable High court Gujarat. Sir/Mam kindly let me know that what are the chances to win this case. and suggest me suitable steps in this regard.
