Original property document mistakes and correction process

Dear Experts,
I am raising this question with name. Sorry i did not know one should not raise as anonynymous.
This is regarding 30 years old, my father's property.
The property was baught by my father from Mr.X, Mr X baught from Mr.Y.
Title Deed1 has East to West 40,North to south 65 area 6 cents Mr X baught from Mr Y.
Title Deed2 has East to West 45,North to south 60 area 6 cents My father baught from Mr X.
Actually East to west supposed to be 60, North to South 45,area 6 cents.
However bit encroachment happened with slight deviations in all four directions and area is 5.5 cents now.
Now father is no more, we (mother, brother and myself) are legal heirs.
We are planning to sell house. Anyway we are not interested in claiming encroachment we are fine with existing area.
My question is,
1.We should amend the original document (and linked document) for right East to West, North to south measurements (which is swapped in original documents) and right measurements which any way less now due to emcroachment and for existing area and then sell?
If yes, what is the process knowing fact that my father is no more and also Mr.X who sold to my father is old and cant move. Mr.Y is no more as well.
OR
2. Can we directly register to our buyer with all corrections just for existing area without correcting oroginal documents.

Please suggest.

Grabbing property

Sirs,
'X' My younger brother who is handling the rent from the common property is not willing to divide the property among the legal successors ( brothers and sisters). the owner of the property is my father and he is no more. Mother also expired. "X' is owning a house and purchased 2 nd house also. I want my share from the common property owned my father; so also my other brother and sister. How to get the property divided? what is the legal remedy? is it possible to charge conspiracy to grab the property without any valid legal authorization? will complaints against my brother who is a Govt. servant, considered by the Govt. Department authority? kindly advice.

Gift deed by son in the name of mother,stamp duty and registration fee in maharashtra state.

My son and myself have a residential flat in Pune in joint names, my son's name being first and myself at second place. We , my son and myself,jointly desire to gift this Flat to My wife, i.e. my son's mother.
My query is ,
1) Whether my Son can Gift this property to his mother and whether I can join the Gift Deed with him ?
2) What would be the stamp duty for this Gift deed and Registration Fee , w.r.t. newly amended and revised Stamp Duty provisions ( Gazette dated 24th April,2015 in the Maharashtra State).

if the unregistered will is with the executor after the owner what are the points to be taken care of ?

Maharashtra govt reduces stamp duty for blood relation property transfer

this law has been brought into effect from 24 april 2015
does this law has any retrospective effect?
if so, can i get a refund
my dad gifted me a property on nov 3, 2014

Effectiveness of consumer courts

Ours is a CHS in Pune.As our builder did not provide us promised amenities like Swimming pool,clubhouse etc nor did he make conveyance deed,we engaged a lawyer who filed a criminal case against the builder for not making conveyance deed.As per the lawyer going to consumer court to get the compensation is a waste of time as very few societies get proper compensation and is a very time consuming process.Instead he says once the builder gets summons from the court he will automatically come forward for settlement.Is the view of the lawyer in not going to consumer court and filing criminal case against the builder to get compensation correct? I want expert opinion on this.Our case against the builder is very strong as he has not even handed over any accounts to society nor did he come forward to form the society.We did it on our own.

cheque bounce

hello experts I have purchased land for some amount in 1990.I have some balance amount to be given to him.gave him a cheque in dat year 1990 for the balance amount.DAT person is telling me DAT he will a criminal case against me for cheque bounce as the cheque got bounced for insufficient funds. please help me legally.

1)If a Charitable Trust wants to appoint some employees for its day to day social work what kind of rules and regulations shall be applicable to such an employee?
2)Is there any format of appointment letter for trust employee?
3)is trust employee applicable for PF?

Right of way dispute

I live in urbanised village in Kotla mubark pur New Delhi-110003. The right of way to our house is a disputed land for the last forty years and has been partly encroached by neighbours and the rest is also under threat of encroachment. there are two parties on both sides of our house. I have lodged complaints with all the possible departments, mcd, dda, sdm office, sho but the action is very little. The SDM has issued orders to MCD regarding preservation of right of way without applying any CrPC and MCD is not taking action. I have filed application under Crpc 145 against one of the neighbourer for last one year but the case is being not heard properly
