Dear Sir/Madam,
A Suit was filed, Defendant appeared Filled W.S., Issues Framed thereafter remained absent, the plaintiff and his PW filled Evidence and the Suit was decree, exectuion petition filled.
There after the Defendant filed application U O.9 R.13 to set a site exparte decree, which as rejected.
thereafter 8 months later filed appeal U/s 96 R/W O.41 R.1 along with delay condolence application challenging the original decree as exparte (Delay has be Condone)
please help me with any citation to get the Appeal Dismiss

RESPECTED lawyers club india experts team,
MY family has agricultural land in my village.this is ancestral property.we have to share equally with my fathers brothers.but he is not accepting for equal share .2)and also what my father's brothers is cultivating with the support of anti social elements is on road side.but my family land is inside it has no way to enter.my fathers brother is not giving any way to us enter into my land that from shared land.then we visited the court.court sanctioned the ad-interim injunction order.
With this we tried to use the way.then my fathers brothers beat my mother.he pulled all the tools.
IN THIS SITUATION WHAT I HAVE TO DO?PLEASE ADVISE TO ME.
ALSO we had complained in policestation.but unfortunately he filed a petty case,instead of voilation of inunction order.
PLEASE explain what i have to do?
WHAT is the punishment for them?

Dear Sir,
after marriage at time of registry i have change my surname from moumita ghosh to moumita ghosh choudhary but my all docs contains my maiden surname, now i would apply for competitive exam, so what name i should give in the form of examination. and also should I give my father name or husband name.
still i didn't get my marriage certificate and the last date of apply for exam is near.
so pls guide me as soon as possible.

Dear all
i cleared my LLB and result out on 31.3.2014.i have not apply for registration with Bar council of u.p.till now but going soon for the same.
I want to know subject to pending registration application to bar council of u.p. , whether can i use designation "ADVOCATE" with my name and whether the same can be printed on my signboard hang on my office.

Hi All,
I have booked a flat in Miraroad comes in Mira-bhayander mahanagar palika,district thane in maharastra.
1) Pls advise can mahanagar palika issue the Plint certificate & CC order without having the NA order.
2) Bulding is under contruction but till date NA order is not received.
It is a 7 storey complex & till date 7 slab is done & work is in progress.
3) Builder is demanding money & bank are not providing loan due to non availablity of NA.
4) Flat has been registered in my name & i have stopped paying demanded money bcoz no banks are financing. But builder has sent me a notice of cancellation.Inthis case what should i do.

Respected Sir,
i am the only son of my father and he is also the only son of my grandfather.
we have a property in Andhrapradesh on both my grand parents name, my grand father passed away few years back.
this property is in court for some loan related issues with some bank for almost 12 years.
my father used to take care of all the court hearings and spent money and time for this 12 years. my father decided to pay the bank that money and want to sell this house now.
my father has three sisters but they never helped my father all these years but they are showing intrest on the propery.
does they have any such rights to claim the property. and if they claim how much percentage they get if the house is on sale.
can you please suggest any idea, if my father or me can get the whole property on our name as my aunts never helped us.

O.41 r.1
Dear Experts,
The proceedings can be taken in concurrence under O.9 R.13 & S.96 to set aside exparte decree, as in case of concurrence filing of both if the application under O.9 R.13 is dismiss then to defendant can proceed with O.41 R.1. but same in not in case of vice versa
but the Legally can a appeal be filed challenging the original exparte decree under O.41 R.1 after dismal of application under O.9 R.13 or it must go under O.43
please do give more light on this.
