I am Tarakeshwar Acharya a resident of hyderabad residing since 3 years and working in a reputed MNC since 2 and half years........And i am staying with my old age parents my father is 72 years old suffering from heart attack and three blood vessels are already blocked.He is a bed-ridden patient my mother is 63 years old with diabetic and low blood pressure patient however manage to take care of house hold activities and i am a 30 year old bachelor till August 2009.
I recently got married on the 15th august 2009.with K.sunita from Hyderabad locally.The marriage was arranged with the help of telugu Matrimonial website.It was an arrange marriage.I am a B.com Honors student from Barkatuallaha University M.P(Bhopal) as per the Matrimonial site the profile of sunita was updated as a student with M.A ,Phd public administrator.Her mother gave a call after looking my profile and my parents were unable to verify the background.........(inregards to family,fitness and the past of sunita's family).As my dad was getting ill day by day and doctor's predicted that he might survive for a week or two. Hence on urgency the marriage arranged on behalf of both the sides on the 15th aug.09.
After marriage sunita came to my house on the 02nd sep.09 as their parents informed its an auspicious day to start a new life and she went back on the very second day because his father was leaving abroad to ryhad.she stayed at her mother's place till the 7th sep.09 as the honurable C.M of hyderabad passed away and there were no means of transport available.i brought her back on the 08th sep.09 and she stayed in my house with my parents and i went to office asusual at 11:30AM and on the same day i received a call from her mother stating that they have to attend a Television Show wanted sunita to come with her.Hence i called sunita to know if she would like to go with her mother to the show she agreed for that and i adviced her to come back once she is done with the show.
However,i never received any phone call from her nor to my parents.I adviced my father to call her to check where they are.On calling her mother informed that she is so tired and sleepy and they would send her off by tommorrow.After coming back from the office we had a small family discussions with my old parents. In regards to the unexpected situation i did not sleep the whole night .I got a call in the morning from her mother stating that she doesn't want to come and stay in my house complaining that the house is sourrounded by sick patients and my mother is torturing her .I went to her place just to clarify with my in-laws and sunita to understand the matter .....as it was been told to her before tha maarige that i cannot stay alone separated from my old parents because there is no one else to take care of them.i insisted & begged several times to come back as its the matter of reputation of both the families and this has affected my old parents health after several discussions she still denied to come.And after a month(since she was staying with her parents) her mother came with few MAHILA MANDAL ASSOCIATION LEADERS to my house in my absence and were arguing that we are torturing her with food and other household duties.and even putting the wrong claim on us stating that my mother is torturing her for dowry ,fortunately those association leaders understood the situation and medical conditions of my parents and became angry on sunita's mother that she has mis-leaded them and spoiling her daughter's life .And went back assuring my parents that it will not be repeated and they will send sunita back to my home .After 3 days of this incident sunita and her mother lodged a FIR complaint in the local police station claiming dowry harresment,and evil treatment with her daughter by her mother -in - law and she wanted us to get saperated .And police took me from my office and gave me the marriage counselling at that time i came to know that sunita never got educated and she is just 10th class failed and unable to read or write properly and she have no friends and she never comes out of her house and never use to interact with anyone and always use to watch television.She wakes up early in the morning at 05:30 AM and goes to bed at 7:30Pm evening and neither can she cook nor mange house hold works she demanded for a worker or a servant to take care of the entire house hold activities.I claimed that it was not possible for me to continue with such a girl when she cannot understand me and my situation.This FIR went to court and i am being harressed by my in-laws that if i do not get sepaerated i will be put behind the bars on the basis of dowry harresment.As its not been know to her father till date as they changed the mobile number of his father and denied me to talk to him nor his father called us.
The sub-inspector of the local police station on the 25th oct.09 forced me to take sunita back to my home where she stayed for only 2 days and went back again early in the morning with out informing me and till date .Again i m subjected to harresments from sunita's family for separation.
(she hardly stayed only 3 days since we got married on different occasions and this is known to all the people of MAHILA MANDAL ASSOCIATION and the police SI.However no body wants to take action on behalf of me inregards for saperation everyone wants that I should manage this marriage life and things would be sorted as the time passes by.)
As the FIr is been lodged and its been pending for arrest warrent for me and my parents under sec.498IPC 3DPA and 4DPA act.I am only person to take care of my parents who even cannot walk properly I am afraid any time the police can come and we all will be in the jail, Hence could you please advice the possible way to get out a bail for my parents and myself so that i can lodge a compalint and fight against the fraud case which is lodged against me and my family.
I Don't want to continue with sunita and my whole life is ruined and they have cheated with me and my parents ,as we have blindly trusted and landed in trouble could you please help me suggesting a proper guidence so that i can go for a legal divorce and can stay away from police tortures

now i want to make a will in my sons name
my question is
i have not transwered that property in my name so far, can i make a will without transwering that property in my name

I had married in 2006. Wife has stayed with me for one month &went back to her maternal house by her own & in 2007 complained vs. us.(me & my Mother)
My wife has put up case vs. me & my mother in 2007 under 498 &420 of IPC. We have arrested &released on bail.
Now she has filed case under Domestic violence application u/s 12 for relief’s u/s 20&22 asking compensation Rs.20 lac towards mental agony, torture, emotional distress hardship, harassment etc. & monthly Rs.10000/- per month as maintenance for our daughter.
Requested court to direct order pay of interim order monthly maintenance @ Rs. 5000/- pm for daughter.
She earns 22000/- Govt school teacher & having her own flat in Mumbai. Flat is locked &she stays with her mother (mother is retired school principal get monthly pension). She says her expenses, are paying E.M.I payment towards flat & car purchase comes around 12500/- & maintenance charge of her flat is 2000/- per month.
Our baby is with her. Baby is 2& ½ year old.
I had earlier working with PSU my salary was Rs.28000 /-pm. Now I am working for pvt. chemical company & my Gross salary is 21000/-. My parents are old (74 & 69 years) & are under medication. My monthly expenses are more than 14000/-. Recently I had lost my money in stock market.
It’s not possible for me to pay as per her demand.
I request you to suggest me best possible action to safeguard me &may parents from cruelty of my wife.
What will court decide as per present law on her demand?
I would like to mention one thing, when she complains to police in 2007. Police asked her to make compromise. Upon which she has given in writing some conditions & asked me to accept those condition. Through RTI I have collected that paper from police.
Those conditions were. 1. I should hand over my entire salary to her 2. I should buy house for her 3. I should not stay with my parents. Etc. paper is signed by her
After marriage I had given her Rs 150000/- By cheque for buying furniture for her house. She took all gold ornaments purchase by me.
i would like to know following information in regard to DV case vs me by my wife.
1. My wife is working in Goverment aided junior college in mumbai. How to get her salary slip. thorugh RTI, is it possible if yes then whom to write &what to write.
2. My wife has mentioned that she is paying EMI for paying back the loan on car & house she bought.how to get the EMI details she is paying to bank from which she is taken the loan. Limited or co-op banks ar coverd under RTI?
Pl suggest.

Respected Seniors and Experts.
In the trial under N.I.Act, I being the defence counsel could not attend the Court due to illness and I filed an adjourment petition on the ground of my illness. Adjourment was allowed subject to payment of cost but at the same time, the court examined the complainant in chief and marked the documents as exhibits and posted the case to two days after for cross examination. On the date fixed since I had not recovered from my illness, I again filed a petition for adjourment on the same ground. The Ld. Magistrate rejected my petition, discharged the complainant and posted the case to next day for accused statement. I have filed a petition under Section 311 for recall of the witness for cross examination.
I request the experts to advise me on the issue supported with case law.

my father died 3 years ago without leaving a will . nowwhat should be done to accquire our right .
he is survived by wife daughter & son.
kindly explain in details the entire procedure.

so, i quoting once gain
That the Hon'ble Tribunal has refused to entertain my request for filing the written arguments.Respecting the advice/direction given by the court, I decide not to file the same But I want to file the citations and judgements summary/brief of some case so that it may help in applicability of the ratio-decidi /judgments before prononcement of the order
So, keeping on above perspective in what manner I should file the citations
Whether by M.A(Miscllanous Application) ???
Please inform whether supporting affidavit is essential???
I will gartful if any member help me in very-very brief outline

One of my friends took a loan from a MNC Bank in 2000. That MNC bank was absorbed by another bank.Friend repaid nearly 50% of the principal amount through PDC.
Due to unemployment , he could not pay the same . After he got a job in 2002 , I paid some installments and last installment was paid on November 2003. No action was taken by a bank under 138 of NI. The PDC had been lapsed.
Now he is working in a company in Kerala whereas he family lives in Chennai.
Now , bank is traced his details tru job sites and started to give trouble asking him to pay the balance dues.
He told them that though the debt is time barred , he is ready to pay a sum on ethical grounds as a one time settlement.
The bank is threatening to file a case.
Is it possible to file a criminal case for the civil offense ( as this has been referred by Justice Raghupathy in 2008),
What is the remedy available to my friend?
Can any Chennai Lawyer wants to help him to come out of this issue?

Respected sir,
1.My father got a land in a village and have proerly registered it in his name .
2. we gave power to a frauderster named deva and also the original document.
3.we have cancelled the power of attorney now.
4.fraudster Deva hasnt used the power, but he has cruelly plotted with another person to created forged document before the year our father bought the land.
5.fraudster on repeated request not giving our documnet back .
5.please help us get back our document and also how to create a Settlemet deed in our name
6.Ec details shows land being sold by those fraudster to other company.

sir,
I am 22 years old and my mother and me are willing to build a house in a plot given by my grandfather
in andhrapradesh.Since we had been brought up in a different state I do not know anyone in that place( my father has expired).
We have no own house and do not have any idea about constructing house before.Most of our neighbours are telling that
it is difficult to beleive in most of the contractors since they might cheat and nowadays it is not good to rely on word of mouth.
I do not want to sell the plot due to sentimental reasons.
Can you kindly suggest me how to find a reliable contractor and whom i should approach to take sugession in construction
i.e., if there is some place where we can get the information and guidence about standard contractors and architects.
the plot is in ponnur(guntur district)and also please inform me if I should appoint a lawyer and make agreement with the
contractor.

bank cheating case
dear sir
it is a bank cheating case of seven lakhs.
in the year 1992 and till 2002 i was appearing. i was granted bail. last 8 years
i could not appear. can i take a no arrest order from the high court of andhra pradesh and appear before trial court prove my innocence will the arrest me after granting me a order in the high court in the trial court
because my lawyer say no one can arrest till the case disposed. is that true what order is that.
