Builder not refunding amount paid for flat

Dear Sir,
In the yr 2011 I have paid a builder Rs. 1 Lakhs, & in the year 2014 again I had paid a sum of Rs. 2 Lakhs - Total Payment is 3 Lakhs towards a flat purchase at Titwala, Thane Dist. In the year 2014 the builder asked us for govt registration, so I had done registration of the flat with a payment of stamp duty of 1.5 Lakhs. total expenses till date is 4.5 lakhs.
But now builder says he is unable to construct the building & will refund our amount. Since Jan 15 I had been following with him for payment , but till now I have not received any payment from him.
I need your guidance -- Shall I go in police or CBI & register a 420, cheating case against him? Pl help me to guide on the same.

first you may send a notice from your lawyer then file complain against the builder.
