can i file IA to make tenants deposit rents

Sir,

my tenant is not giving rents since 2 years.

he has filed IA seeking permission of court to deposit rents but has not done till date.

In the absence of written agreement he has falsely stated lesser rents, even that he is not paying.

I am surviving on rents only for my livelihood.

It has become difficult to sustain my family.

My counsel is not guiding me properly.

Respected Sir, What should I do?

Bring it to the notice of the court that the tenant have not deposited the rent. What is the matter before the court? If you have filed a suit for eviction, then file an application for striking off his defence as he have not deposited the rent.

What is your prayer in the petition and on what ground you have filed? Whether you have filed Counter to the IA or not?.Whether the IA is pending or ordered?If IA is pending move a urgent petition and seek direction from the court to get the permission for collecting your rent.
