Cbi case - prevention of corruption act

Guest (Querist) 27 May 2013 This query is : Resolved
Respected distinguished members, i will be grateful to receive an answer to my query.

There is element of 'presumption' in Prevention of Corruption Act. whether this presumption applies only to the Accused caught red handed or can be stretched even to the other Accused to whom the alleged bribe money never reached and the conversation also has no incriminating substance and the conversation is perceivable in different ways.Further there is no corresponding incriminating action on the part of the said other accused in fulfillment of the unwitting ,misleading and throwaway utterances coming from his mouth and the Central Forensic Lab Experts opinion confirms as to the 'probability' of the voice of that accused. Please tell me whether this other accused can be roped in/ convicted along with the Accused who has been caught red handed by CBI.

Implication of law is always case specific that too depending upon the circumstances in which the event took place.

So, unles you provide description of the problem, whether it relates to you in person, or you have to quote in other's case in the capacity of Director and under what circumstances, etc., no specific opinion can be arrived at. So, please state the real problem with appropriate background of the case.

Your query is just a discussion over a legal provision. It shall be better if you post the facts leading your case so that appropriate reply may be given.
