Claim on deceased mothers ornaments, which got pledged for loan ?

(Querist) 29 April 2013 This query is : Resolved
dear sirs/madams, my friend"s mother pledged her gold ornaments and obtained loan from a private financial institution. in that loan application she has given her husband name as nominee. now she is no more leaving behind her husband and two major daughters. but husband is absconding since two years. so, please let me know the procedure to get back the jewels with out delay. financial instition is bothering about her husband arrival and reclaim.

Since husband is also one of the legal heirs, they are rightly denying it. Only option is to apply for Succession certificate for 2/3rd share of the daughters so the same can be claimed by paying the loan amount.

Apply for the succession certificate by filing P & Sc petition. You said your father is absconding, so array his as respondent and follow the procedure
