Dear sirs,
I am aged 23. I completed my Bcom recently and then i joined a firm of CAs. After working for 2 yrs with them i quit the job and started to work independently as Tax consultant after getting certificate as practitioner from dept of Comm taxes. I file monthly returns of a few clients, appear for assessments and maintain books of accounts etc.
These days i am facing a lot of problems in the Tax depts. the clerks who work their are causing unnecessary delay in doing their work such as issuing statutory forms etc. The applications filed by me are not accepted stating technical errors and i have to do the same things thrice unnecessarily.
Morover if they are in a foul mood they scream at me at the top of thier voice in front of all. They have absolutely no mannerisms in their behavior with the dealers or a few consultants like me. However they are good with a few who pay for getting work done.
I have explained these things to there senior officer who i find is not able to control them even now.
I am in no mood to indulge in any corrupt practices whatsover in order to get my work done quickly. we are thought from our college days not to favour corrput practice.
In this situation
1. can i complain under instructions from my client to the Commissioner or to the Lokayukta.
2. Can delay in performing work can be a reason to file complaint with lokayukta.
I did not want to take these extreme steps but i fear that delay caused by these ppl will result in problems for my client to whom i am answerable. Since i am not a established consultant any client lost would make my living difficult.

Yes you can file a complaint to the commissioner.
You can also lodge the complaint before Lokayukta.
To file a complaint befoe Lokayukts there must be corruption.

As you rightly said any complaint either to the Commissioner or to the Lokayukta may result in hardships to you. Moreover, to approach Lokayukta, some one should have demanded illegal gratification for attending to your work.
Legally speaking, as you have not been demanded any illegal gratification, you cannot approach Lokayukta. You may complain to the Commissioner of Commercial Taxes about the inordinate delay in attending to your work.
The best way to tackle the issue is to perfect your work and make correspondence (not complaints) about delays with the higher ups.

Every Govt. office has a "Citizen's Charter" wherein it is spelt out as to which work will be performed in how many days.
Firstly, you get a copy of the Citizen's Charter from the office by making an application under the RTI Act and then you get information about all the applications made by you for different works under the RTI Act with notings and details as to for how many days the application remained with which officer/official with official notings and the reasons for delay in disposal of applications. You may also get information about disposal of similar applications of other practitioners.
Hopefully the clerks will start behaving properly within very short span of time.
This has been suggested to you after successfully implementing it a number of times and in number of offices.

thank you all for your valuable suggestion sirs, i was not aware that citizen charter lays down the time limit of disposal of application. i will obtain the same from the RTI. thank you for your valuable suggestions.

But the said citizen charter does not specify the time limit for any disposal of work.

The Citizen Charter of every government office provides time limit for accomplishment of all the acts, deeds and things pertaining to that office.

Firstly for issuing of statuory forms lodge complaint with Public Relation Officer of tax department.Secondly your applications are not accepatable because of procedural errors on your part and not for technical mistakes.Thirdly you use sweet language and not foul language while dealing with Govt. servants as they are not your servants.Fourthly there are Grievances Cell wherein you have report to them.Finally you can approach the top brass in the tax department for any grievances but can contact them without piror appointment during the said hours.

You can write to PRO asking for the due time for disposing the application and statutory forms. After that you can have the information under RTI. Above all, you must fill in the form correctly and there should not be any lacuna in this respect.
