Contract or agreement vaild or not

(Querist) 17 January 2024 This query is : Resolved
Hello....please mention

any contract OR agreement, if signed by First Party and not signed by Second party and with no witnesses....

Whether that contract OR agreement is valid or complete..

please provide any judgments if any..
T. Kalaiselvan, Advocate (Expert) 17 January 2024
A written contract must be signed by both parties to be legally enforceable.
A contract not signed by one party makes it an agreement that isn't legally binding. Valid contracts need to have all required elements in it, and they are enforceable under law. The two parts of a contract are the offer and acceptance.

What are the context as well the facts?

It is an academic query. However, in any document, the witness signatures are important and in your query, the 2nd party signature is a must hence it is not valid.

Sir..Its a technical question...and not academic query.
Whereas, I have asked the experts to provide some judgments on this point... which says the valid conditions for valid contract/agreement must be signed by both the parties
T. Kalaiselvan, Advocate (Expert) 21 January 2024
The position of law has been explained. yo ma look for relevant judgments through google search or any legal website.

Please provide some case laws... If possible
T. Kalaiselvan, Advocate (Expert) 26 January 2024
You may have to look for the judgements yourself, we don't supply them here.
You can ask your lawyer.
Since this is position of law, hence you don't have to rely upon any ruling to establish your case.
