How beneficial is DV Act practically if a wife is getting harassed by her husband and in-laws? I have read the DV act and rules, but is it beneficial to go for this? How much is the expenditure for filing such case and where it is to be filed?riven

It will depend upon facts and circumstances of the case. No straight jacket formula. I would recommend you to go for amicable settlement instead of litigations.riven

DV Act is a unique legislation wherein the relief to the aggrieved wife is provided very fast. Not only compensation against the harassment is provided therein but also regular allowance, shelter, right to live in the house of husband, right to restrain husband to dispose off his property, shelter to victim and her children and many other releifs are easily available under this act. There are 3 means to start this litigation. One by directly making application before Ilaka Magistrate, other is to lodge complaint with Protection Officer and third one is to make complaint before Ilaka Police Station. No huge amount is liable to be incurred in starting this litigation.riven

Domestic Violence Act is a comprehensive law and addresses all issues related to women. It is for the first time that an act has been made to address women's issues in such detail. The Act is an extremely progressive one not only because it recognizes women who are in a live in relationship but also extends protection to other women in the household, including sisters and mothers thus the Act includes relations of consanguinity, marriage, or through relationships in the nature of marriage, adoption, or joint family thus, 'domestic relationships' are not restricted to the marital context alone. So it is unique & benificial in its own way.

If wife has filed case under DV Act and court has ordered and provided residence to her. Is it compulsory for wife to stay in that house for full time even if she doesnot feel secure there. Are there any chances of filing complaint my husband and in-laws if wife is not staying there and reversal od order by court. Plz advise.riven
