Sale of house

Respected sirs.,

MYself srikanth from Tamilnadu state-

I am having one apartment house- I have decided to sell the property in the month of Oct-2011-in which the tenant of the said house(for the past 4 yrs he's in the house for rent(no rent agreements made)willing to purchase the house from me.

An mutual agreement is made in between us for the sale of value of Rs.6.50 lacs in which an amount of Rs.1.50 lacs given as advance- rest to be settled within the 2 months latest by 09/12/2011.

Unfortunately the tenant unable to complete the task also about 5 months have gone. In the mutual agreement(20 rs stamp paper)sale amount, advance amount & settlement date were mentioned other than that nothing was included.

Now i would like to know the following

1. Should i require to issue final notice to the tenant based on the mutual agreeement by giving final notice. If yes how many days should be given in addition also could i add interest in the notices

2. For the past 4 yrs he was tenant for the house is he have any legal rights!.(no agreement for rent was made)

3. Should i sale the property to third party by issuing notice to the tenant!.
If yes how much time i should mention for vacanting the house.

Whether the notices can be issued from my end or otherwise through lawyers.

Issue legal notice terminating the contract. After termination you can sell the property.

Issue the notice mentioned witt he termination of agreemen and vocatiing house with one month time if they fail then. You can sell the property

Dear Mr.Srikanth you have to issue a termination notice cancelling the document along with the advance amount taken in a DD so there is an unilateral cancellation of sale agreement carried out.
