How to get the divorce

Dear Sir,
My cousin sister (32 yrs) got married a man(32yrs) on 2002 and have one boy kid (Age 4 years now). The kid is staying with his father's mother from 8th month of his birth. My sister and her husband are seperated for the past 2 years due to misunderstanding and not allowing the kid to live with her. Due to this, my cousin sister is living with her parents.
Now she want to get the divorce. But her marriage was done in Special Hindu Marriage Act with that man. Right now, she is not having the marriage certificate. He is not giving all of her certificates. She has resigned her job also. Please advise us to get the divorce for her. thanks.

The certificate is lost and if marriage was solemnised by going through Hindu rituals, rites and customs then file case Hindu Marriage Act.

There is no law in the name of specil Hindu marriage Act so first of all clear this point ao as to clarify other related points.

There is no Hindu special marriage act. It is special marriage court.
Except court decree your sister wont get divorce by other means.

First of all tell your cousin to be proactive and cannot get any result through you (hope you are not impersonaing to be your cousin.
If she is interested in any settlement and/or divorce,then she (your cousin) must engage a lawyeer and seek advise on the issue of divorce and/or custody/meeting right with child.

Advice,how to get divorce,is not provided here.Only advice on the procedure and laws are given.Well she can obtain a duplicate marriage,its not a problem.Better ask your cousin to have a family councelling along with her husband,I think she may get some respite.Divorce for evry minute misunderstanding is no solution in life.God has given us a beautiful life in this wonderful world.It is left to us to lead it in a positive way and derive happiness.Family councelling is my priority.

CAN OBTAIN DUPLICATE MARRIAGE CERTIFICATE.
THERE IS NO SPECIAL H LAW.
Look for child's future, before ur sister's misunderstanding & divorce. .

The duplicate certificate can be obtained.
Then file for divorce in relevant provision.,
