IF the compliant filed u/s.138 by complanat co operative society through its officer upon a resolutin which only contian about filling suit for A/C dues against accused whether accused is entitled for acqiatal?
Devajyoti Barman (Expert) 03 January 2010
The resolution is sufficient to authorise the official and dismissal of the complaint on that ground alone seems to be misconceived.
Sukhija (Expert) 03 January 2010
what is the stage of ur trial in court? if accused is acquitted then he is rightly been acquitted but if the trial is pending then file authority letter to file complaint and to depose also.
Raj Kumar Makkad (Expert) 03 January 2010
The resolution is absolute and it complies with the requirement. The accused cannot be acquitted only on this ground.
