my grand father leave 500 sqyd house . this property miltry cottage after his death .govt pass go no.166 date 2008 to regularzise and transfer the property but my uncle and aunty dnt mention my mother name in legal heir certificate . and he try to regulerzise and transfer to his name . please what do my mother legal way to take share . and what share come my mother name my caste muslim total 2 brother 3 sister please give me advise . secunderabad andhra pradesh india

Your mother should make a representation to the concerned Government office to the effect that your uncle and aunt have suppressed the material fact and they have not provided the true legal heirship certificate of your grand-father and moreover you mother is required to provide true picture of legal heirs so that the appropriate action may be got initiated failing which file a writ before high court.

Ask your mother to give written communication to the authority so that her name is also recorded.
iF THEY DO NOT MAKE IT THEN GO TO HIGH COURT AND FILE Writ petition..

It may take about 3 years to decide the partition suit if the parties do contest. Suit is required to be filed within the jurisdiction of which such property situates.
