Can failure to deliver goods after receiving sale consideration be remedied under the Consumer Protection Act and if so under which section of the Act.

Deficiency in service is defined in S.2(g) and a complaint under S.12 of Consumer Protection Act 1986 lies before a Dist Forum(up to 20 lac rupees), Consumer Commission(from 20 lac to one crore rupees) or National Commission (exceeding one crore rupees), within 2 years from accrual of cause of action (S.24-A).

With due respect to expert K.S.Srinivas the best course is to file complaint under CPA as it is summary in nature and has to be decided within 150 days or so without any fee/stamp duty to be paid by complainant.
