Forcing to give letter

An employee, with respectable designation in top/middle management cader of an organisation; asked by his employer to quit the job; instead of a termination;it is a forceful resignation.
The employee also agrees for the resignation; and now
the employer forcing an employee to give a letter of not revealing the secrets of the company; and
being employed in the similar organisation (particularly meaning the competitors)
Failing which the settlement will be done by the employer
Experts please advise,
a) what will be the consequence if the letter is given
- the employee will get settlement
- even after giving the letter also he can reveal the secrets or join with its competitor.
b) what will be the consiequence if the letter is not given
- employee will not get settlement; take a long route for a rightful claim.
- without giving the letter also he can reveal the secrets or join with its competitor.
Advise the employee...!!

you cannot join the competitior or reveal secrets of the company .
you should not betray the trade secrets of the organisation that you have worked for many years .
if you fail to give letter company may not give you the reliving letter . the company may create hurdles in your receiving your settlement dues .
you will have long messy legal battle ahead .
even if you do not sign the letter of not reliving secrets of the company if you inform the competitiors company will file case against you

What is the reason for forcing you to resign is big question, more over what you mean that settlement of amount, you mean EPF or other.
IF your part is genuine then you can approach the labour office and file a complaint.

The true reason for the employer compelling the employee for resignation is that
the EMPLOYER FORCING AN EMPLOYER TO COMMIT THE MISTAKE WHICH IS AGAINST TAX LAWS AND OTHER LAWS
employee refuses to do which is abnormal; and agrees to leave the organisation; but fails to give the letter as drafted by the employer.
The real advise from the experts is required..!!
now with the following option
a) forego the settlement claims including PF claims
b) commit to agree the crimes against the man made law.
c) Rightful fight lodging complaint to the respective departments (including corruption and concealing of information etc. etc.)
Experts please advise ..!!

The problem remains unsettled..
briefing out the fact (name and figs are not true)
a) Employer forcing to book/write expenses (amounting to bribery) the employee, in finance department fails to execute
b) the employer forced the employee to resign instead of termination for obvious reasons
c) now employer compelling the employee to give a letter as aforesaid, or the settlement will not be made..
d) The employee remains out; and could not move at either side..
e) The is at puzzle; and seeks the advise of the expert as to
i) can this be lodged as complaint to the finance department/ministry
ii) respective department for the concealment of facts
iii) can lodge a complaint at the Ministry labour or state labour board
iv) can challenge the employer pulling him to the road (not physically; but for the concealment of facts)
v) forego everything and remain with nothing... :(
