Pay protection

Sir,
I'm working in central group- A Service and after a promotion now I'm in grade pay of 6600 (6th CPC)...

I've been selected in provincial civil services of UP and the post I'm selected for carries grade pay of 4800.

I took valid NOC. On the application of forms from the department at all stages of the exams.

I'm now concerned as im getting conflicting views whether I'll be getting pay protection on switching from central to state service...

Kindly help as it its a very pressing issue for Me

Why anonymus? In ur case no pay protection as this is new appoinment and the employer is different.

you are entitled to pay protection unless the new post is lower than the present post.

I am thnakful that Mr Narasimha has endorsed my views as well as views of Mr Gabriel. But our view are contradictaory.

Mr Gabriel replied that

"In ur case no pay protection as this is new appoinment and the employer is different."

I commented

"you are entitled to pay protection unless the new post is lower than the present post"

Mr Dhingra also expressed views contrary to mine.

I have to be thankful that Mr Gabriel did not feel insulted nor did I felt so.

Dear Sudhir,

Of course, my views are contrary to that of yours, so far as you stated that the querist was entitled to pay protection. If you don't mind, your views are based on probability of 50:50, not on the status of the posts as per the GP, while mine are based on the status of the employee, as he went from Group A post to Group B post. No Group A post had GP of Rs.4800/-, as per the 6th CPC. As per the CCS(RP) Rules 2008, the employee was selected for PB-2 post, while he was holding higher post of PB-3.

In fact, the query of the anonymous querist is doubtful in itself, may that be merely an academic query and not his real problem, as neither NOC is permissible for transfer to lower post, nor the application could be forwarded through proper channel for lower post.

Reply of Mr. Isaac Gabriel was also not wrong, as per the extant rules of the Government of India.

Mr Dhingra has elaborated my views without annoying and proved that which I felt as contradiction is not contradiction.

Movement to lower post (even if it was within same classification)is generally not a public interest.

It is not the question who is right and to what extent what I am aggrieved against is the derogatory comments exchanged by some experts.
