Petition withdrawn without consent

A reckless activity by a lawyer who withdrew the petition without the consent of the client very next day after taking the money . He is not even bothered in giving the Original copy of the Order.

What should I do ?

How the Order copy could be obtained ?

What is the time limit for filing a petition for contempt of court ?

How much is the cost involved for filing the petition ?

The conduct of your lawyer as alleged is more akin to professional misconduct than acts committing contempt of court. You can any time apply for the certified copy of the order of the court.

Take the certified copy of the order and issue notice to the advocate claiming the compensation. You cannot file contempt of court case against the accused.

you can file a petition invoking the inherent powers of the court and alleging that the case has been withdrawn fraudulently by your lawyer without your consent and seek recallin g the order and proceed futher with the same.

My opinion in this matter is, you have to approach the higher court by way of review or appeal stating all the facts and get the lower courts' order set aside and restore the case to file. You should immediately obtain the court order for the filing of appeal/review petition against the lower court's order.
