Hindu Minority & Guardianship Act.

Querist : Anonymous (Querist) 17 March 2011 This query is : Resolved 
1) After divorce/separation, the husband can move an application for the custody of a child under Guardian & wards Act AND if the parties are Hindu then under Hindu Minority & Guardianship Act ?

Query : So we can say that Guardian & wards Act are not apllicable to hindu but applicable to any other religion who are not hindus because for hindu Hindu Minority & Guardianship Act is applicable itn't it ?

No, the Guardian and Wards would be very much applicable.

Husband can file any time before the child attaining majority. Divorce between parents will not affect the issue
