Petitioner lawyer out of country

(Querist) 15 August 2012 This query is : Resolved
Sir,
In a contempt case before the high court the petioner lawyer did not attend the court when it was listed and the hon. judge has kept it for dismisal.
When the case came up for hearing for dismisal the respondent advocate asked for adjournment.
After that for some reasons the judge was on leave for almost about two months. Now the judge is present but the petitioner lawyer is out of country. The junior lawyer is not well versed with the case.
Now if the judge refuses to give adjournment will the case put forth by the petitoner be dismised.

Hopefully case may get adjourned on mention of the junior.
adv. rajeev ( rajoo ) (Expert) 15 August 2012
It can be dismissed. Petitioner has to appear before the court and seek for the adjournment.
Ramkrishna (Querist) 15 August 2012
Sir,
Should the petioner himself should appear before the court and ask for adjournment or could the junior lawyer ask for adjournment.
The petitoner is working in Goa and the case is in the high court of AP.
