Property share

(Querist) 18 January 2013 This query is : Resolved
My father was a business man. He paid Rs 10,000 to market association in the year 1980 towards setting up of new market
complex. I have proper documents regarding this transaction. Father closed business in the year 1984 and he died in the year
1995. Recently I came to know that Market association has cancelled the new market proposal and announced that they are giving
away the deposit along with the interest of Rs 1,10,000. I have my mother and three sisters who are married in the year 1968,
1978 and 1983 respectively. Now I have no good terms with them. Market association is asking for no objection from sisters and
mother which I am not in a position to provide. As they are well settled they may not be intrested in this refund and I tried
to convince market association that I am ready to give indemnity bond but they are not agreeing. Can you give me your advice?
In worst case if I demand my share them what is the amount I get and what is the possibility.

Being a legal heirs of your father all are entittle for equal share in that amount. You have to convince your sisters and mother to get the no objection to get the money in your name.

To me the stand of association is just and proper as besides you there are 4 others to share this amount equally along with you, that counts only 1/5 for you,1/5 th each of your three sisters, and 1/5 th of your mother. Why do you expect that association should risk it's liability even after paying you entire against your proposed indemnity.
