(Querist) 26 January 2013 This query is : Resolved 
we have application in high court pending. we are tenant and landlord just file affidavite for rent according to market price. is we have to pay according to mkt. price. Is there is new law for this or we can argue back on what ground?
we lost twice in small cause now our application admitted in high court and we skip rent to pay in small cause for same we applied in highcourt of mumbai. in reply landlord ask for mkt price rent and affidavite made for same and court to order vacant order against us.

the Landlord must have move an application for 'Mense Profit' and you must have lost the Eviction proceedings before Rent Controller.

Landlord's application is very much maintainable, the Rent Controller may assess the Rent as per market rate during the pending proceedings.

However, you may contest the matter on merits, but the things favour Landlord in such circumstances.
