Declaration of death

Dear sirs,
A person driver by profession has died in an accident about 3 months ago but his body alongwith the truck he driving has drowned in the river Chenab ,only the part of his truck showing the no. of the truck is found by the police.now his family wants to file claim case in the labour court , is it possible to file the same without the death certificate ,

Dear rajoo,
Thnx for responding ,in the fir it has been written that such no. Vehicle driven by such has person has been drowned in the river and not found after lot of search.
