In family property case one of my relatives have furnished false/fake document before the civil court and filed civil suit that property belongs to him whereas as per revenue and registry the property is equally divided among legal heirs. Written complaint was submitted to SSP who would only forward the same to SHO/IO for investigations but FIR was not lodged and police insisted for compromise. Due to my service in other state on & off I could not visit the police station and at times their were also threads to my life from my relatives which I also informed to SSP through FAX. Then I approached the HIGH COURT and Judge told that I should first approach the District Magistrate of the Area where I reside. Then my advocate prayed for withdrawal of petition to file before the appropriate Magistrate of the Area which was dismissed as withdrawn with Liberty to aforesaid as per orders of High Court. My query that can I submit High Court orders alongwith petition to SSP to register case against my relatives for misusing the false/fake document before I approach the District Magistrate of the Area. Please advice.

You need to file a criminal case in district court and request the magistrate to issue orders to police to file a FIR.

The high court orders are for your information only. it may not help . you need to file a suit in the district court.

That right I need to file criminal case for which I approached the High Court for directions to be issued to Police, but High Court replied that I should approach the District Area Magistrate, for which the case was dismissed as withdrawn by my advocate to file before the District Area Magistrate. Now I am not in position to approach the District Area Magistrate and someone suggested that I can also sent my complaint to SSP of concerned area alongwith copy of High Court orders. Please suggest that if it would be approriate to sent copy of High Court orders alongwith complaint to SSP to register case.

You will have to engage a local lawyer for proper proceedings.
The complaint can be filed by your father, brother, mother, sister and or any other person residing at your home.

I intend to file complaint with Sr.Supdtt. of Police with copy of High Court order alongwith petition as I do not want to approach District Magistrate Area as I again have to engage lawyer. Can I proceed to approach SSP and explain my situation personally.

High Court Orders reads "Dismissed the petition as withdrawn with Liberty to aforesaid" Dear Experts please clarify that this High Court orders have no value by no means. If I approach the District Magistrate Area can I enclose this copy of High Court orders.

1. What else do you expect from High Court when you have withdrawn your petition? Of course, high court order is required to be annexed.
2. If you are dissatified with the guidance, advise and proceedings of your lawyer, change him/her immediately.
3. The experts have advised you adequatly,no room left.
4. Now it is your call to take action, you may approach the person/authority you consider the "best".
