Tds booked payment not received

Dear sir
I am working as a contractor with some companies. 1 company has booked tds but not given payment what shud i do.

You may serve a Notice on the Company, preferably through an Advocate requesting for TDS Certificate.

Claiming payment is civil matter.

You can show this amount as receivable and can account for the TDS in your return.

You can lodge complaint with I.Tax Inspector -TDS where you file ITR, CIT-TDS where company files ITR, that it has deducted TDS but has not released the payment/payment detail.


Pursue thru RTI if required.

Let the company submit whatever reply it wants to make.


You may also issue legal notice thru your lawyer.

The company must deposit the deducted amount with the I.T. department, failing which it attracts penalties. Hence, file a petition to the I.T. Department that the company has deducted Income-tax from you but not given any certificate to that effect.

You can mention the TDS in the relevant column of the ITR by mentioning the name of the company that deducted Tax at Source. The IT department will take care of further issues.
