Querist : Anonymous (Querist) 29 October 2010 This query is : Resolved
Dear Sirs,
Please guide..
1..Can I carry notes to refer with details of complaint(a key document around which case is revolving) filed while I am in witness box? (during exam in chief & cross) I am a lady having no command over local language.

2. Can I request to mention important points when deposing when judge is dictating? Some times judge does not dictate key points.

Please guide...

Whether a lady or gents will not be allowed to carry any written material to the witness box for the purpose of referring and answering the queries put to the witness. As a witness you are only supposed to answer the questions put to you. You cannot ask the judge to mention important points what he is dictating. Yes, if you are not able to hear the question or if the question is not clear to you, you can say I am not able to hear the question; or I am not able to understand the query. Thereafter either the quetion will be put to you little loudly, or the question will be asked very clearly.
