(Querist) 23 July 2011 This query is : Resolved
Respected Learned Friends,

I feel happy after browsing your website as it has several useful information. Hope any one of you can help me with regard to the subject cited above. I have a small property which was purchased by my father in the year 1986 The owner of the property has executed the GPA in the name of my mother, and now my mother and Father are no more,I am the only son to my parents, and the Executor of the GPA and her legal son and Grand Son are also no more.
I have a copy of the Death Certificate of the Executor of GPA of my property
Now how can I register my property. How to transfer or Register my property to my wife and children.

Please Help me in this regard.

When GPA executant is no more then it is not valid GPA. After the death of GPA executant it looses itz validity.

If it is ok for you, please send the copy of the GPA to my email-id rrc@inbox.com Let me go through the GPA and tell.
In the meanwhile, please also confirm whether there is any WILL also simultaneously granted by the executor of the GPA?

IT SEEMS MUST TO GO THROUGH CONTENTS OF GPA BEFORE OPINING ANY THING.

Your query is conflicting in its meaning.
One time you are talking about purchase by your father and then GPA in favour of your mother.

If your father has purchased the property then why does on earth the owner would execute the GPA.

Or you by owner mean to say your father. If that is so then after their death then the property devolves upon you or your other siblings, if any.
RAJU O.F., (Expert) 27 July 2011
Confirm as to whether your father had purchased the property and had registered the sale deed in his favour.
Arun Kumar Bhagat (Expert) 07 August 2011
If the property is registered in the name of your father then there is no necessity of any GPA. You being the legal heir automatically becomes the owner of the same.
