Re: new laws for parking

I stay in Pune in a co-operative society and own a 1 bHK Flat. Our building will soon undergo redevelopment as per Joint Consortium..But I have been told that as per the latest parking laws since I own a 1 BHK I can get parking only for cycles and bikes and not for cars.? Only people with 2 or 3 BHK flats are entitled to a car parking and If I want a car Parking I will have to buy another flat in the same society..??Is this True..I want to know the exact rules..Are there any such rules , bye-laws governing parking?? Pls help..Thanx for ur help, advice and time.

it depends on bye laws of co-operative society.

each flat owner is entitled to car parking slot . ceheck bye laws adopted by your society . it clearly provides each member would get one slot . if there are more flat owners than car slots then it would be on lottery basis

A housing society has no law making powers. It can only make by-laws within the four walls of the laws of this country.

ThankYou Experts... Thankyou R.K. Nanda Sir and Ajay Sethi Sir..Sorry to reply so late..But can I ask one more query:From where or from whom can I know the bye-laws of my society...? Coz nobody is co-operating with me in our so called "co-operative society"..Also Thanks to Sir P.Venu..And can I ask Sir P.Venu a more elaborate explanation of ur statement..Are u saying that there are certain laws which are binding on the bye-laws of a society ? Bcoz the way my society members behave as if they are the lawmakers of this country..I would be grateful to u P.Venu Sir,if u Could pls let me know what laws are binding on parking bye-laws...Thank you all the Experts once again..thanks a lot for all ur valuable time, help and advice ..!

1. You are "presently" owning a One BHK flat. Obviously "after" redevelopment you "should" be owning a TWO BHK. Hence logically you would be entitled to one parking, as per the Society people.

2. Irrespective of above, every member is entitled for one parking space (if available), irrespective of anything. IF the Society fails to allot you one parking space, THEN you may file a grievance-petition with the local Consumer Court, against the Society.
