We wanted to own a shop for pagdi amount rs. 16,50,000 and monthly rent 2400 and rs. 1,70,000 was paid as token amount on 7th Dec 2015. This is a rented shop and we were told the transfer fees by the tenant 31000 and rate of increase in rent 200 rs. per year. So we agreed upon the deal. But now we come to know that transfer fees is increased to 2 lakh and 25% annual increase in rent on 16th Dec 2015. Now we don't want this deal done. How can we recover out token money. They dont want to return the token money. Plz guide and help......

1. Serve a legal notice upon him through an advocate alleging him of dishonestly quoting false amount of the transfer fees and thereby inducing you to part with your money and warn him if he does not return the token money then you will be at liberty to file a criminal complaint of cheating and inducing you to part with your money which is a punishable offence u/s 420 of I.P.C. If the reply is not coming forth or is not satisfactory then file such criminal complaint with the police.

Whether any agreement was signed at the time of payment of token money?
Consult local lawyer and discuss in detail after showing all the documents.

In all such dealings there wont be any evidence hence the problem has to be sorted out through amicable process only. You cannot initiate any legal action on such illegal transactions.
