Pre litigation dispute notice from reliance communications

(Querist) 30 August 2013 This query is : Resolved
Dear Sir/Madam,

I was using Reliance Wi-Max some two to three years ago when I was in Pune. After five-six months, I discontinued the service and switched back to another Internet provider. Now, I don’t live in Pune anymore, I moved back to my hometown, since July, 2012. I think, I have settled the last billing amount. I have provided my E-mail ID at the time of applying for connection. I haven’t been contacted by Reliance for the last 2-3 years. Now, out of nowhere my friend (who is currently living there in Pune) have called me and told me that, you have got a “Pre-litigation for the outstanding billing amount of Rs.1541/-“from "Pune District Legal Services Authority, District Court, Shivaji Nagar, Pune" on the given address. I am asked to pay the claimed amount on 22/09/2013 at the time of hearing at “Pre-Litigation Mega Lok Adalat”.

Anyways, I am ready to pay the amount. Do I need to go for the customer court to meet “Pre-Litigation” Or this issue can be resolved by paying the outstanding amount at the nearest Reliance center??

Pleased help me on this. Thanks in advance.

Regards

better attend personally and pay the outstanding amount of Rs 1541. in the alternative depute your friend with an authority letter to attend proceedings on your behalf and to pay the outstanding dues

Thank you very much for your valuable words sir. But, I wish to pay the outstanding amount. Will this issue be solved by paying the outstanding bill before the appearing date??

Lok Adalat may settle the matter for Lesser amount, say Rs. 500-1000.
You can file Vakalatnama , to any local Advocate with instructions to settle the matter. It will do, and you need not wait for whole day at Pune Lok Adalat, and can save your time and trouble.
It will be comfortable,
cost effective,cheaper.
As Lok Adalat are on SUNDAY, PROBABLY YOU HAD A HOLIDAY AND CAN PRESENT YOURSELF TOO.

since complaint has been filed before lok adalat better make payment before the authority only

That's right sir. But, the problem is, that I don't live in Pune anymore and I have to spend extra 1500 bucks to come to Pune only. So, will the issue be solved by paying the outstanding amount at the nearest Reliance center??

You can entrust the matter to any of your friend at Pune by giving authority letter as advised . Better course would be to engage a Lawyer there. you may deposit it at reliance center and take the receipt. You have to inform the lok adalat accordingly on the day of hearing.

The matter is before LOK ADALAT:

U need to get urself represented & settle it there only.
don't go personally, delegate it.

You need not go personally.
You can pay the amount at any one of the nearest Reliance centers. Take the receipt. Photocopy the same and send it under a covering letter to (i) the Lok Adalat stating that you have made the payment vide receipt No. dated .... at ..... Reliance Center (ii) copy to concerned Reliance office at Pune. PERIOD. NOTHING WILL HAPPEN.

Thank You everyone for your valuable words. It was very helpful.

In my opinion first ask your friend to send a scan copy of the notice and get the amount asked deposited on any Reliance center of convenience with reference to details of the notice noted on the receipt with seal and sign and then send the same to your friend with an authority letter to attend the pre litigation proceedings where he would need to show the original receipt and file a photostat copy thereof.

Simultaneously you should also ask Reliance center receiving the amount to communicate by email to the Reliance office claiming the amount that the amount so due shown in prelitigation notice for date 22/09/13 issued by Pune Lok Adalat has been received by them with a cc forwarded to your email address too for record.
