Dear Sir/madam,

I have the below mentioned query:

Can an upper tehsildar of any district pass an order/give judgement of loan recovery case. Basically what I know is Upper tehsildar is responsible to give orders in land matters/recovery revenue certificate..ie. who owns a land and has defaulted in paying the dues.
But Can he pass orders in personal loans/homeloans/credit cards too.

1. The State Govt., could have delegated the "Upper Tehsildar" with special powers of an "Magistrate" (of a class). However this depends on the location, wherein the local court may not be available.

1. File an "Right to Information" application under section 6 of the Right to Information Act, with the area Collector, asking him to provide you the certified copy of :

a) order, wherein the "Upper Tehsildar", has been delegated authority to pass orders on matters related to "personal loans/homeloans/credit cards".

b) Order wherein the "Upper Tehsildar" has been delegated authority with special powers of an "Magistrate"

Find out from the District Collector office whether the Upper Tehsildar is delegated such powers or not.
